In Liverpool they are listed in the breach of covenants inasmuch as the company imported on to the site excess topsoil, deleterious and noxious deposits and materials, asbestos, asbestos related materials, refuse, fly tipping, and to put it in perspective, “The premises are in a worse situation than the ‘existing condition’ in which they were demised to you in the commencement of the Lease”.
Should we imagine that what happened in Liverpool/Knowsley was repeated in West Lancashire? Back in the day, neighbours of the BPGC complained of obnoxious smells from the 9holer. The complaints were dismissed. Are we suspicious enough that there is some noxiousness there? We should be told.
